Terms of Use
These terms cover how you use this website. They are not a construction contract. If Berg does work for you, your signed written contract controls that work.

1. Who we are
This website is run by Berg Development Inc., a California corporation. In these terms, "Berg", "we" and "us" mean Berg Development Inc.
Berg is design-build, led by a licensed general contractor with a degree in architecture. We build backyard residences, roofs, and solar and battery systems. A backyard residence is what California law calls an accessory dwelling unit (ADU). Our Legal notices show how to check what our license covers.
- Company
- Berg Development Inc., a California corporation
- Contractor license
- CSLB #1111136
- Address
- 2316 W Victory Blvd, Burbank, CA 91506
By using the site, you agree to these terms. If you do not agree, please do not use the site. You can always call us instead.
2. Using this site
You can use the site to:
- type a property address and see public records for that lot;
- see a 3D model and a price estimate;
- ask for a Design Session, a call-back or a site visit;
- send a roofing or solar order request and pick a start week;
- follow your project in the project portal, if you have one.
You must be 18 or older to use the site.
You may look up any address in our service area. Only send an order or book a session for a property you own or have the right to improve.
Berg works in California. Backyard residences and roofing are offered in Los Angeles County. Solar is offered across California.
3. Estimates, 3D models and prices
What you see on the site is a starting point. It is not a bid, a survey, a permit decision or a contract.
Where the numbers come from
When you type an address, the site reads public records for that lot from Los Angeles County and city data services. These include the parcel outline, assessor facts, building outlines, building heights from aerial laser scans (LiDAR), tree cover, fire hazard zones and zoning. Our own software also looks for pools in county aerial photos.
Public records can be old, incomplete or wrong. We do not promise that they are correct.
The 3D model
The 3D model of your lot, your house and your roof is drawn by software from those records. Windows, doors, trees, driveways and roof shapes are illustrations. Sometimes an AI model reads the county aerial photo to estimate the shape of a roof. That is an estimate too.
Online prices
Online prices come from Berg's price table and from quantities in the public records or numbers you enter. A price marked "Estimate" is a number that Berg has not confirmed yet. It is not final.
For a backyard residence, the studio shows a construction estimate. The written proposal that follows a Design Session sets the scope, the price and the schedule.
The site's read of what fits on a lot is preliminary. Only the city or county can approve a permit.
The site visit
Before any work starts, Berg checks the real quantities at your property.
Roofing and solar: how the online price is confirmed
For a roofing or solar order placed online, your contract explains how the online price is confirmed. In short:
- If the checked quantities change the price by 5 percent or less, the contract price stands.
- If they change the price by more than 5 percent, up or down, Berg writes a change order with the corrected quantities and price before work starts.
- You can accept the change order. Or you can cancel at no charge and get your down payment back.
The contract has the exact wording.
The signed contract controls
Berg does work only under a written contract signed by you and by Berg. If this site and your contract say different things, the contract wins. Nothing on the site changes a signed contract.
Rent, savings and loan numbers on the site are examples. See our Legal notices.
4. Orders and week holds
When you send a roofing or solar order on the site, you are sending Berg a request. It is not yet a contract, and you do not pay on the order page.
- Your week is held, not promised. You pick a start week and the site holds it for you. A held week is a request until Berg confirms it.
- A person reviews every request. Berg confirms your week, offers another week, or tells you that we cannot take the job.
- Berg can decline. Before a contract is signed, Berg may decline or cancel a request. One example: the roof is not what the records showed.
- You can cancel. Before you sign a contract, you can cancel a request at any time. Call or email us.
Payment starts only after you sign the written contract. After you sign, the contract sets out your right to cancel.
5. The Design Session fee
A Design Session is a paid meeting about a backyard residence for your lot. The fee is $500.
- Asking is free. Sending a request costs nothing. You do not pay on the form. Berg confirms the time with you, and the fee is billed by invoice.
- Refundable until the session. If you cancel before the session takes place, Berg refunds the fee in full.
- Credited to your project. If you go on to build with Berg, the $500 is credited in full to your project contract.
- Not a construction contract. The Design Session does not commit you or Berg to build.
The Design Session Agreement lists what you receive and has the full terms. If these terms and that agreement differ, the agreement wins.
6. Project portal and access codes
Customers with a project get a private project portal. It shows your agreement, schedule, photos, comments, invoices and documents.
- Your access code. You open the portal with an access code that Berg gives you. After an online roofing or solar order, the code may also be shown on your order confirmation screen.
- Keep it private. Anyone who has your code can see your project. You are responsible for what is done in the portal with your code.
- Tell us fast. If you think someone else has your code, call us. Berg can issue a new code, which turns the old one off.
- Comments. Comments you post in the portal are read by Berg's team. Keep them about your project. Do not post card numbers or other people's private details.
- When a project closes. Portal access ends when a project is cancelled or archived. You can still ask a person at Berg for copies of your documents.
The crew page and the admin page are for Berg's team only.
7. Acceptable use
Please use the site fairly. You agree not to:
- break the law, or anyone's rights, with the site;
- try to get into the admin page, the crew page or another customer's portal;
- guess access codes or PINs;
- use bots or scripts to run address lookups in bulk, or copy the site's data in bulk;
- overload the site or try to get around its limits;
- send fake orders, or hold weeks you do not plan to use;
- send us another person's name, phone number or email without their permission;
- upload viruses or other harmful code.
The site limits how many lookups, forms and orders one connection can send in a day. We may block access to protect the site and our customers.
8. Our content and yours
What belongs to Berg
Berg owns the site and what is on it, or uses it with permission. That includes the text, the software, the 3D studio, the price tables, the floor plans, the renderings, the films and photos, and the names of the residences in our catalog.
You may view the site. You may save or print your own estimate, report and plans to plan your own project.
You may not copy, sell or publish our plans, renderings or catalog. You may not give them to someone else to build from. Ask us for written permission first.
Concept plans and designs that Berg prepares stay Berg's property, unless your written contract says something different.
What stays public
County and city records are public. We do not claim to own them.
What belongs to you
What you send us stays yours. That includes your details, your notes and your portal comments. You give Berg permission to use them to answer you and to carry out your project.
Berg's crew takes photos of your project and shows them to you in the portal. Berg uses pictures or film of your property in its marketing only if you agree in writing, for example in your contract.
9. Other companies' brands
The site names products and brands that we install or work with. Examples are makers of solar panels, inverters, batteries, roofing, windows and fixtures.
Those names and logos belong to their owners. We use them only to say what the products are.
A brand name on this site does not mean that the company sponsors Berg, endorses Berg or is connected to Berg.
We do not claim to be an authorized dealer or a certified installer of any brand unless a page says so plainly.
10. Services from other companies
Parts of the site run on services from other companies:
- Cloudflare hosts the site and stores its records and the files people upload.
- DocuSign handles online signing, when it is set up.
- Xero handles invoices and pay links, when it is set up.
- Los Angeles County, city data services and the U.S. Census Bureau supply public data.
- OpenStreetMap data comes to the site through Overpass API servers that other groups run.
- Freddie Mac's public rate survey supplies the mortgage rate in our payment example.
- An AI model from Anthropic may read an aerial photo to estimate a roof shape.
- Google Fonts and jsDelivr deliver the typeface and the 3D library.
When you sign in DocuSign or pay from a Xero invoice, you are on their pages. Their own terms and privacy policies apply there. Depending on their settings, they may email you about a signing or an invoice. Those emails come from them, not from Berg's website.
We do not control these services. They can change, slow down or stop. Then parts of the site may not work. You can always call us.
Our Privacy Policy says what each of these services receives.
11. No warranty for the website
In short: we work to keep the site right, but we cannot promise it is perfect. Sections 11, 12 and 13 apply to the extent California law allows.
We provide the website "as is". That means we make no warranties about the website itself. For example, we do not promise that:
- the site is free of errors or always available;
- the public records, 3D models and estimates on it are correct;
- the site is fit for a particular purpose.
This section is about the website only. Warranties on construction work are different. They are written in your signed contract and nowhere else. For roofing and solar work, the workmanship warranty written in your contract sits next to each maker's product warranty. The website does not add to those warranties or change them.
Nothing in these terms takes away rights that California law says cannot be waived.
12. Limits on our liability
In short: we are not responsible for losses that come from relying on the website, and for claims about the website itself we owe at most $500. The exceptions are listed below.
- Berg is not liable for losses that follow indirectly from your use of the website. Examples are lost profits, lost savings, or a decision made from an online estimate before a site visit and a signed contract.
- Berg's total liability for claims about the website itself is limited to $500.
These limits do not apply to:
- Berg's duties under a signed written contract, which has its own terms;
- injury to a person or damage to property caused by our work;
- fraud, willful misconduct, gross negligence or a violation of law;
- anything else the law does not let us limit.
13. If you misuse the site
In short: if you misuse the site and that gets Berg sued, you cover Berg's reasonable costs. Berg's own fault is not included.
Suppose you break these terms or misuse the site, and someone makes a claim against Berg because of it. Examples are attacking the site, sending fake orders, or sending us another person's details without permission.
In that case you agree to cover Berg's reasonable losses and costs from that claim, including reasonable attorneys' fees. This does not cover claims caused by Berg's own negligence or misconduct.
14. Changes to these terms
We may update these terms. We post the new version on this page and change the date at the top.
New terms apply to your use of the site after they are posted. They do not change a contract you have already signed.
15. Governing law and venue
California law governs these terms and your use of the site.
A court case about these terms or about the site must be filed in the state or federal courts in Los Angeles County, California. If California law lets you file in the county where you live, that right stays. You and Berg both agree to those courts. Small claims court stays open to you and to us for claims that qualify.
A dispute about construction work is covered by your signed contract. You can also contact the Contractors State License Board at cslb.ca.gov or 800-321-2752.
16. General
- If a court finds that part of these terms cannot be enforced, the rest stays in effect.
- If we do not enforce a term right away, we can still enforce it later.
- These terms are the whole agreement between you and Berg about using the website. They are not the agreement about any work.
- Our Privacy Policy, Cookie and storage notice, Accessibility statement and Legal notices are part of how the site works. Please read them too.
